A quoted price that undercuts the market by a wide margin is often explained by where the waste ends up.
Penalties for Non-Compliance
Non-compliance with NEMWA is not a trivial matter. Offences under the Act carry penalties of up to R10 million in fines, imprisonment of up to 10 years, or both. These penalties apply in addition to any other sanctions that may be imposed under the National Environmental Management Act (NEMA).
At a municipal level, the City of Cape Town’s Integrated Waste Management By-law empowers Waste Management Officers to issue compliance notices to any person found to be contravening the by-law. Ignoring a compliance notice constitutes a criminal offence in its own right.
Should a business fail to act on a compliance notice, the Waste Management Officer is authorised to arrange for the clean-up, removal, and lawful disposal of the waste — and to recover every rand of those costs from the responsible party.
Integrated Waste Management Plans: A Non-Negotiable Requirement
Who Needs an IWMP?
Any commercial entity that produces waste — whether on a permanent basis or temporarily for an event — is required to have a formal Integrated Waste Management Plan (IWMP) in place. This requirement applies to producers of industrial waste, general commercial waste, hazardous waste, and medical waste. The City of Cape Town requests these plans regularly, and not having one in place when called upon to produce it constitutes a contravention of the by-law.
An IWMP documents how a business intends to manage its waste streams in a manner that is legally compliant and environmentally responsible. It covers waste generation volumes, segregation practices, storage methods, transportation arrangements, and the treatment and disposal options being used.
What a Good IWMP Should Cover

Businesses are also required to keep records of their waste generation and management activities on an ongoing basis. These records form the evidentiary basis should the business ever need to demonstrate compliance to a Waste Management Officer or in a legal proceeding.
Waste Management Licences and Registration
When Is a Licence Required?
Not all waste management activities require a full Waste Management Licence (WML), but many do. Activities that typically require either a licence or registration include the storage of waste above certain volume thresholds, sorting and processing of waste, recycling and recovery operations, treatment of waste, and disposal to land.
For example, the storage of general waste in excess of 100 cubic metres requires registration, while storage of hazardous waste above 80 cubic metres triggers licensing obligations. Businesses that recycle hazardous waste above 500 kilograms per day, or treat general waste at volumes exceeding 10 tonnes per day, must hold the appropriate licences before commencing those activities.

Businesses should request these certificates as a matter of routine rather than only when something goes wrong, and file them alongside the waste records required under the by-law. Practically, that means keeping:
- Copies of your contractor’s waste management licence and transport permits, checked for current validity and for the waste types they actually cover.
- Signed manifests for every hazardous waste collection.
- Safe disposal certificates for each load, matched against your own collection log.
- Volume and frequency records, which are also what an auditor will use to sense-check whether your reported waste generation is plausible.
If a contractor cannot readily produce a disposal certificate for work already carried out, treat that as a warning. Under Section 16 the resulting exposure sits with the generator, not only with the operator who cut the corner.
Proper Segregation, Storage, and Transportation

Transportation Requirements
Moving waste from a business premises to a treatment or disposal facility requires careful planning. Transporters must be appropriately licensed and equipped with vehicles suitable for the type of waste being carried. All hazardous waste must be accompanied by the required SDS and manifest documentation throughout transit.
Proper labelling of waste containers during transport is essential — both for the safety of those handling the waste and for regulatory traceability. The manifest system ensures that every party involved in the chain — the generator, the transporter, and the receiving facility — acknowledges their role and confirms the safe transfer of waste.
Liquid Waste and Trade Effluent
Liquid waste carries obligations that catch businesses out more often than solid waste does, because it is generated continuously and leaves the premises through infrastructure rather than in a skip. Trade effluent discharged to sewer must meet the municipality’s acceptance limits, and anything outside those limits must be intercepted, treated, or removed by tanker instead.
